LEGAL PROFESSION UNIFORM LAW APPLICATION ACT 2014 - SECT 100

Legal Practitioners' Liability Committee

    (1)     There continues to be a Legal Practitioners' Liability Committee.

    (2)     The Liability Committee

        (a)     is a body corporate with perpetual succession; and

        (b)     must have a common seal; and

        (c)     may sue and be sued in its corporate name; and

        (d)     may acquire, hold and dispose of real and personal property; and

        (e)     may do and suffer all things that a body corporate may, by law, do and suffer and that are necessary or expedient for the purpose of performing functions and exercising powers under the Legal Profession Uniform Law (Victoria) and this Act.

    (3)     The common seal must be kept as directed by the Liability Committee and must not be used except as authorised by the Committee.

    (4)     All courts must take judicial notice of the common seal on a document and, until the contrary is proved, must presume that the document was properly sealed.

    (5)     The Liability Committee is the same body as that established by section 234 of the Legal Practice Act 1996 and continued by section 6.6.1 of the Legal Profession Act 2004 .
