LEGAL PROFESSION UNIFORM LAW APPLICATION ACT 2014 - SECT 124

Payments out of the fidelity fund

There must be paid out of the fidelity fund—

        (a)     any claim (including interest, costs and disbursements) allowed or established against the fidelity fund; and

        (b)     all legal and other expenses incurred—

              (i)     by the Victorian Legal Services Board in investigating or defending claims made against the fidelity fund; and

              (ii)     in the exercise by the Victorian Legal Services Board of the rights, powers and authorities vested in it by Part 4.5 of the Legal Profession Uniform Law (Victoria) in relation to the fidelity fund; and

        (c)     any amount required to be paid out of the fidelity fund under section 126 ; and

        (d)     any amount required to be transferred to the Public Purpose Fund under section 127; and

        (e)     any loss incurred on the realisation or revaluation of any investment of the fidelity fund; and

        (f)     any amount determined by the Auditor-General to defray the reasonable costs and expenses of an audit of the accounts of the fidelity fund.
