LEGAL PROFESSION UNIFORM LAW APPLICATION ACT 2014 - SECT 153

Investigation of offences and contraventions

    (1)     If the Victorian Legal Services Board reasonably suspects that an offence has been committed under this Act or the Legal Profession Uniform Law (Victoria) (other than an offence under Part 4.2 of that Law), or that a civil penalty provision has been contravened, the Victorian Legal Services Board may appoint a person—

        (a)     who is an employee referred to in section 59(1); or

        (b)     who in the Victorian Legal Services Board's opinion is an appropriate person to conduct an investigation under this section—

to investigate the offence or contravention.

    (2)     Chapter 7 of the Legal Profession Uniform Law (Victoria) applies to, and in connection with, an investigation under this section as if—

        (a)     a reference in that Chapter to a trust records investigation were a reference to an investigation under this section; and

        (b)     a reference in that Chapter to an investigator were a reference to a person appointed under subsection (1).

    (3)     Part 9.9 of the Legal Profession Uniform Law (Victoria) applies to, and in connection with, an investigation under this section as if a reference in section 462, 465 or 467 of the Legal Profession Uniform Law (Victoria) to a relevant person were a reference to a person appointed under subsection (1).
