LEGAL PROFESSION UNIFORM LAW APPLICATION ACT 2014 - SECT 169

Government lawyers

    (1)     Subsection (2) applies to a person who is not an Australian lawyer but who, at any time within the period of 12 months immediately before the commencement day, was a person referred to in section 2.2.2(2)(g) of the old Act.

    (2)     For the purposes of section 56 of the Legal Profession Uniform Law (Victoria)—

        (a)     the person is exempt from the requirement to hold an Australian practising certificate in respect of his or her official functions as a government lawyer; and

        (b)     sections 10(1) and 11(1) of the Legal Profession Uniform Law (Victoria) do not apply to the person in respect of his or her official functions as a government lawyer.

    (3)     Subsection (4) applies to a person who is an Australian lawyer and who, at any time before the commencement day, was a person referred to in section 2.2.2(2)(g) of the old Act.

    (4)     For the purposes of section 49(1) of the Legal Profession Uniform Law (Victoria), any period of legal practice engaged in by the person before the commencement day, whether supervised legal practice or not, is taken to be a period of supervised legal practice, and is to be subtracted from the period of supervised legal practice required by the statutory condition imposed by that section on an Australian practising certificate granted to the person under the Legal Profession Uniform Law (Victoria).
