LEGAL PROFESSION UNIFORM LAW APPLICATION ACT 2014 - SECT 92

Legal Costs Committee

    (1)     There continues to be a Legal Costs Committee.

    (2)     The Legal Costs Committee consists of—

        (a)     the Chief Justice or another Judge, Associate Judge or reserve Judge of the Supreme Court nominated by the Chief Justice; and

        (b)     the Chief Judge or another judge, associate judge or reserve judge of the County Court nominated by the Chief Judge; and

        (c)     the Chief Magistrate or another magistrate nominated by the Chief Magistrate; and

        (d)     the President of VCAT or another member of VCAT nominated by the President; and

        (e)     2 members nominated by the Attorney-General, at least 1 of whom is not an Australian legal practitioner; and

        (f)     2 members nominated by the Victorian Legal Services Board; and

        (g)     one member nominated by each local professional association.

    (3)     The Chief Justice or his or her nominee is to be the chairperson of the Legal Costs Committee.

    (4)     A quorum of the Legal Costs Committee is a majority of the members of the Committee for the time being.

    (5)     A question arising at a meeting of the Legal Costs Committee is determined by a majority of votes and the person presiding has a deliberative vote and, in the case of an equality of votes, a second or casting vote.

    (6)     Subject to the Legal Profession Uniform Law (Victoria) and this Act, the Legal Costs Committee may regulate its own procedure.
