ROAD SAFETY ACT 1986 - SECT 16G

Secretary may maintain records of persons driving non‑automated motor vehicles

S. 16G(1) amended by No. 49/2019 s. 116(Sch.  1 item 29(a)).

    (1)     The Secretary may create and maintain a record in relation to any person who drives, or intends to drive, a motor vehicle on a highway.

S. 16G(2) amended by No. 49/2019 s. 116(Sch.  1 item 29(b)(i)).

    (2)     The Secretary may create a record in relation to a person—

        (a)     when the person first applies for a driver licence or learner permit under this Act; or

S. 16G(2)(b) amended by No. 49/2019 s. 116(Sch.  1 item 29(b)(ii)).

        (b)     if the person does not hold a driver licence or learner permit granted under this Act—when the person comes to the attention of the Secretary or Victoria Police in relation to the use of a motor vehicle by the person; or

        (c)     in any other prescribed circumstances.

    (3)     The information that may be recorded against a person in the record is as prescribed.
