RESIDENTIAL TENANCIES ACT 1997 - SECT 498Q

Application to Director to investigate need for non‑urgent repairs

S. 498Q(1) amended by No. 9/2023 s. 174.

    (1)     An SDA resident or their chosen person may apply to the Director to investigate whether the SDA provider is in breach of a duty to ensure that the SDA dwelling is maintained in good repair if—

S. 498Q(1)(a) amended by No. 9/2023 s. 174.

        (a)     the SDA resident or their chosen person has given the SDA provider written notice advising the SDA provider that repairs (other than urgent repairs) are required to the SDA dwelling; and

        (b)     the SDA provider has not carried out the repairs within 14 days after being given the notice.

    (2)     On an application under subsection (1), the Director

        (a)     must investigate; and

        (b)     may negotiate arrangements for the carrying out of repairs if the Director is satisfied that the SDA provider is in breach of the duty to maintain the SDA dwelling in good repair; and

        (c)     must give a written report to the SDA resident and their chosen person (if any).
