RESIDENTIAL TENANCIES ACT 1997 - SECT 91ZZU

Renter may challenge notice to vacate on grounds of family violence or personal violence

S. 91ZZU(1) amended by No. 40/2022 s. 16.

    (1)     On or before the hearing of an application for a possession order, a renter who has received a notice to vacate under section 91ZI, 91ZJ, 91ZK, 91ZO, 91ZP, 91ZQ91ZR, 91ZZEA or 91ZZEB may apply to the Tribunal challenging the validity of the notice to vacate on the grounds that the relevant act or breach for which the notice to vacate was given was caused by the act of a person who has subjected the applicant to family violence or personal violence.

    (2)     An application under subsection (1) must be made within 30 days after the notice to vacate is given.
