SEX OFFENDERS REGISTRATION ACT 2004 - SECT 64

Person with access to Register not to disclose personal information from it

    (1)     A person authorised to have access to the Register or any part of the Register must not disclose any personal information in the Register to any person.

Penalty:     240 penalty units or imprisonment for 2 years.

    (2)     Despite subsection (1), the Chief Commissioner of Police or a person authorised to have access to the Register or any part of the Register may disclose personal information in the Register to a government department, public statutory authority or court

        (a)     for the purpose of judicial functions or activities; or

S. 64(2)(ab) inserted by No. 3/2019 s. 49(2).

        (ab)     for the purpose of the performance of a function of a law enforcement agency under any Act or law; or

S. 64(2)(b) amended by No. 82/2014 s. 21.

        (b)     as authorised or required by or under any Act or law; or

S. 64(2)(c) amended by No. 21/2016 s. 7(1)(a).

        (c)     if the Chief Commissioner or a person authorised to have access to the Register believes on reasonable grounds that to do so is necessary to enable the proper administration of this Act; or

        (d)     for the purposes of an order made under Part 4A (other than an order under section 66ZD or 66ZE).

    (3)     Despite subsection (1), the Chief Commissioner of Police or a person authorised to have access to the Register or any part of the Register may disclose personal information in the Register to the Australian Crime Commission for entry on the Australian National Child Offender Register.

    (3A)     Despite subsection (1), the Chief Commissioner of Police or a person authorised to have access to the Register or any part of the Register may disclose personal information from the Register as authorised by Division 10 of Part 3.

    (3B)     Despite subsection (1), the Chief Commissioner of Police may disclose personal information from the Register as authorised by section 66ZZC.

    (4)     In this section—

S. 64(4) def. of Australian Crime Commission amended by No. 3/2019 s. 49(3)(a).

"Australian Crime Commission" means the Australian Crime Commission (by whatever name described) established by the Australian Crime Commission Act 2002 of the Commonwealth;

S. 64(4) def. of government department inserted by No. 3/2019 s. 49(3)(b).

"government department" includes a government department (however described) of a foreign jurisdiction;

S. 64(4) def. of law enforcement agency inserted by No. 3/2019 s. 49(3)(b).

"law enforcement agency" means—

        (a)     Victoria Police; or

        (b)     the police force or police service (however described) of a foreign jurisdiction;

S. 64(4) def. of public statutory authority inserted by No. 3/2019 s. 49(3)(b).

"public statutory authority" includes a public statutory authority (however described) of a foreign jurisdiction.
