Victorian Current Acts Victorian Current Acts(1) A mortgagee or annuitant may, with the consent in writing of the registered proprietor of the land subject to the mortgage or charge and of the registered proprietors of any mortgage or charge registered subsequent thereto, vary the terms of the mortgage or charge or the principal sum interest or annuity secured thereby by an instrument of variation in an appropriate approved form.

(2) For the purposes of this section, the variation of a mortgage does not include the following—
(a) a transfer or assignment of a mortgage; or
(b) an alteration of—
(i) the length of the term of the mortgage; or
(ii) an area of mortgaged land; or
(iii) the parties to a mortgage.
