VICTORIAN CIVIL AND ADMINISTRATIVE TRIBUNAL ACT 1998 - SECT 157

Power to make rules

S. 157(1) amended by No. 11/2021 s. 62(1).

    (1)     The Rules Committee may make rules regulating the practice and procedure of the Tribunal, including any rules required or permitted to be made by this Act or necessary to be made to give effect to this Act [6] .

S. 157(1A) inserted by No. 11/2021 s. 62(2).

    (1A)     If the Rules Committee makes Rules at a meeting (including a meeting held by remote means) the quorum requirements specified in section 155 apply.

S. 157(1B) inserted by No. 11/2021 s. 62(2).

    (1B)     The Rules Committee may decide the procedures for making Rules other than at a meeting.

    (2)     Without limiting the matters in respect of which rules may be made, rules may be made for any matter referred to in Schedule 2.

    (3)     The power to make rules is subject to the rules being disallowed by the Parliament.

    (4)     Rules made in relation to service of documents may provide for service outside Australia of applications to the Tribunal only with leave of the Tribunal constituted by a member who is a legal practitioner.
