(a) the transfer of ownership of a water share under this Division; or

(ab) the transfer of ownership of a water share that is subject to a mortgage recorded under clause 1 of Schedule 12A; or
(b) the giving of a limited term transfer under this Division; or

(ba) the giving of a standing assignment; or
S. 33X(1)(c) substituted by No. 48/2021 s. 14(1)(b).
(c) the assigning or further assigning of the whole or a part of a water allocation under section 33U or 33V.

(3) The Minister must not—
(a) give an approval under subsection (1)(a)—
(i) if any fee under Division 9 that is payable in relation to the share is outstanding; or
(ii) for any other prescribed reason; or
(b) give an approval under subsection (1)(b) or (c) for any prescribed reason.

(4) In giving an approval under subsection (1), the Minister must apply any relevant rules made under Division 13.

(5) An approval under subsection (1)(a) or (b) remains in force—
(a) for the prescribed period; or
(b) if no period has been prescribed under paragraph (a), for 2 months.
