WORKERS COMPENSATION ACT 1958 - SECT 37

Transitional provisions in respect of payments into the custody of the Board

    (1)     On and from the appointed day, all moneys paid into the custody of the Board pursuant to this Division as in force before that day shall be administered by the Tribunal in accordance with this Act.

    (2)     For the purposes of subsection (1), the moneys shall be paid to the Tribunal or, where any of the moneys were before the appointed day invested, the investments shall be transferred to and vest in the Tribunal.

    (3)     The Board, the Registrar of the Board, the Tribunal and the Registrar of the Tribunal shall do and are hereby empowered to do all such acts and things as are necessary for the purposes of this section.

    (4)     No right interest or claim in or with respect to any money paid into the custody of the Board pursuant to this Division as in force before the appointed day shall abate or be in any way prejudicially affected by reason of this section.

    (5)     All other acts matters or things of a continuing nature made done or commenced by or on behalf of or in relation to the Board or the Registrar of the Board with respect to moneys paid into the custody of the Board pursuant to this Division as in force before the appointed day and immediately before that day of any force or effect or capable of acquiring any force or effect by virtue of this Act as in force before that day shall be deemed and taken to have been made done or commenced by or on behalf of or in relation to the Tribunal and the Registrar of the Tribunal respectively.

    (6)     Any reference to the Board or the Registrar of the Board with respect to moneys paid into the custody of the Board pursuant to this Division as in force before the appointed day in any Act regulation notice demand order legal or other proceeding contract lease mortgage agreement instrument document or any writing of any kind whatsoever shall, so far as relates to any period after the appointed day and if not inconsistent with the context or subject-matter, be deemed and taken to refer to the Tribunal and the Registrar of the Tribunal respectively.
