WORKPLACE INJURY REHABILITATION AND COMPENSATION ACT 2013 - SECT 294

Powers of ACCS in conciliation

S. 294(1) amended by Nos 73/2016 s. 21(9), 15/2021 s. 28(2)(a).

    (1)     ACCS may do any one or more of the following things in connection with the conciliation of a dispute or any part of a dispute—

S. 294(1)(a) amended by No. 73/2016 s. 21(4).

        (a)     make such recommendations to the parties to the dispute as ACCS considers to be appropriate;

        (b)     in the case of a dispute arising under section 9

S. 294(1)(b)(i) amended by No. 5/2021 s. 16.

              (i)     give a direction that information relevant to a claim for compensation or a request for provisional payments is to be given to the person who requested the information; or

              (ii)     notify the person who requested the information that there is a genuine dispute with respect to the giving of the information requested;

S. 294(1)(c) amended by No. 15/2021 s. 28(2)(b).

        (c)     in the case of a dispute to which section 297 applies, give directions under this Subdivision;

S. 294(1)(d) amended by No. 15/2021 s. 28(2)(c).

        (d)     decline to make any recommendation or give any direction;

S. 294(1)(e) inserted by No. 15/2021 s. 28(2)(d).

        (e)     dismiss the dispute.

    (2)     Unless a court determines otherwise, ACCS may—

        (a)     conciliate with respect to a dispute; and

        (b)     make or give relevant recommendations or directions—

even though the dispute is pending determination in proceedings under this Act or the Accident Compensation Act 1985 .
