ROAD SAFETY ROAD RULES 2017 - REG 176

Stopping on a clearway

Rule 176(1) amended by S.R. No. 96/2019 rule 8.

    (1)     A driver must not stop on a length of road to which a clearway sign applies, unless subrule (2) or (3) applies to the driver.

Penalty:     3 penalty units.

Note to rule 176(1) revoked by S.R. No. 88/2018 rule 6(1).

    (1A)     In subrule (1)—

"road" does not include a road related area.

Note

Road related area is defined in rule 13.

    (2)     The driver of a public bus or public minibus may stop on the length of road if the driver is dropping off, or picking up, passengers.

    (3)     The driver of a commercial passenger vehicle while providing a commercial passenger vehicle service may stop on the length of road if the driver is dropping off, or picking up, passengers.

    (4)     A clearway sign applies, for the days or times indicated on the sign, to the length of road beginning at the sign and ending at the nearer of the following—

        (a)     a clearway sign on the road that indicates different days or times;

        (b)     an end clearway sign on the road;

        (c)     the end of the road.

Note

Public bus and public minibus are defined in the dictionary. Commercial passenger vehicle and commercial passenger vehicle service are defined in the Commercial Passenger Vehicle Industry Act 2017 .
