GUARDIANSHIP AND ADMINISTRATION ACT 2019 (NO. 13 OF 2019) - SECT 109

Urgent administration (missing person) orders

    (1)     VCAT may waive any of the requirements set out in section 100, 102 or 103 and make an urgent administration (missing person) order under section 105 if VCAT is satisfied on reasonable grounds that there is an immediate risk of harm to the property of a missing person if the order were not made.

    (2)     As soon as practicable after making an administration (missing person) order that is an urgent order (but within 42 days after making such an order) VCAT must hold a hearing to determine whether an administration (missing person) order that is not an urgent order should be made.
