GUARDIANSHIP AND ADMINISTRATION ACT 2019 (NO. 13 OF 2019) - SECT 154

Who are the parties to a rehearing?

The following persons are parties to a rehearing—

        (a)     in the case of the rehearing of an application referred to in section 150

              (i)     the applicant for the rehearing; and

              (ii)     any person who was a party to the proceeding on the application at first instance;

        (b)     in the case of the rehearing of a reassessment referred to in section 151

              (i)     the applicant for the rehearing; and

              (ii)     any person who was a party to that reassessment;

        (c)     any other person VCAT orders to be joined as a party.

Note

Section 60 of the VCAT Act provides that VCAT may in certain circumstances order that a person be joined as a party to a proceeding.
