(1) An applicant for registration as a building practitioner in the category of builder, class of domestic builder (unlimited), is exempt from the requirements of section 170(1)(b)(i) of the Act if, immediately before 1 May 1996, that applicant—
(a) was approved by the approved guarantor under section 23 of the House Contracts Guarantee Act 1987 in the class of general builder or general supervisor, and was the person nominated to the approved guarantor as the person in charge of construction by the applicant; or
(b) was the person nominated to the approved guarantor as the person in charge of construction by a partnership or company approved by the approved guarantor under section 23 of the House Contracts Guarantee Act 1987 in the class of general builder or general supervisor.
(2) An applicant for registration as a building practitioner in the category of builder, class of domestic builder (limited), is exempt from the requirements of section 170(1)(b)(i) of the Act if, immediately before 1 May 1996, that applicant—
(a) was approved by the approved guarantor under section 23 of the House Contracts Guarantee Act 1987 in the class of restricted builder or restricted supervisor and was the person nominated to the approved guarantor as the person in charge of construction by the applicant; or
(b) was the person nominated to the
approved guarantor as the person in charge of construction by a partnership or
company approved by the approved guarantor under section 23 of the
House Contracts Guarantee Act 1987 in the class of restricted builder or
restricted supervisor.
