Party may apply for referral to Tribunal without conciliation

124. Party may apply for referral to Tribunal without conciliation



(1) A complainant or respondent may apply in writing to the Tribunal to have
an expedited complaint referred to the Tribunal for hearing under Division 7
without the complaint going to conciliation.

(2) The application must be made within 7 days after the applicant is given
notice under section 114(2) to attend the conciliation.

(3) The Tribunal must begin to hear the application within 14 days after
receiving it and must determine it as expeditiously as possible.

(4) The parties to a proceeding on an application under subsection (1) are the
complainant and the respondent.
