How may an investigation be initiated?156. How may an investigation be initiated? (1) If the Tribunal becomes aware of circumstances where a contravention of Part 3, 5 or 6 of this Act or Part 2 of the Racial and Religious Tolerance Act 2001 may have occurred (other than an alleged contravention that is the subject of proceedings before the Tribunal), the Tribunal may refer the matter to the Commission for investigation. (2) If, in the course of performing its functions under section 162, the Commission becomes aware of circumstances where a contravention of Part 3, 5 or 6 of this Act or Part 2 of the Racial and Religious Tolerance Act 2001 may have occurred, the Commission may, with the consent of the Minister, investigate the matter. (2A) If, in the course of dealing with a complaint, the Commissioner becomes aware of circumstances where a contravention of Part 3, 5 or 6 of this Act or Part 2 of the Racial and Religious Tolerance Act 2001 may have occurred (other than the contravention alleged in the complaint), the Commissioner may refer the matter to the Commission for investigation. (3) If, in the course of investigating a matter under subsection (1), (2) or (2A), the Commission becomes aware of circumstances where a contravention of Part 3, 5 or 6 of this Act or Part 2 of the Racial and Religious Tolerance Act 2001 may have occurred (other than the contravention being investigated), the Commission may investigate those circumstances.
