Dealing with new complaints218. Dealing with new complaints (1) A complaint may not be lodged with the Commission in respect of an alleged contravention of the old Act. (2) If an alleged contravention of the old Act, if proven, would also have been a contravention of this Act had this Act been in operation at the time, a person may lodge a complaint with the Commission under this Act in relation to the alleged contravention as if this Act had been in operation at the time. (3) Subsection (2) does not apply- (a) if the person had lodged a complaint under the old Act in relation to the same subject matter; or (b) if the Commission had refused to extend the time for the lodging of a complaint under the old Act in relation to the same subject matter. (4) This section applies despite anything to the contrary in section 14 of the Interpretation of Legislation Act 1984.
