Discrimination in the disposal of land

47. Discrimination in the disposal of land



(1) A person must not discriminate against another person-

   (a)  by refusing to dispose of any land to the other person;

   (b)  in the terms on which any land is offered to the other person.

(2) Subsection (1) does not apply to the disposal or offering of a leasehold
interest in land for the purpose of accommodation.

(3) The provisions of this section apply despite anything to the contrary-

   (a)  in any Act, other than this Act;

   (b)  in any document affecting or relating to the land;

   (c)  if section 97 of the Transfer of Land Act 1958 or the
        Subdivision Act 1988 applies to the land, in any document created by
        or in relation to a service company or owners corporation referred to
        or established under either of those Acts in relation to the land.

(4) A person is not personally liable for breach of any covenant or obligation
contained in any document referred to in subsection (3) if the person would
have contravened this section if the person had complied with the covenant or
obligation.
