Harassment by employers and employees86. Harassment by employers and employees (1) An employer must not sexually harass- (a) a person seeking employment with that employer; (b) an employee of that employer. (2) An employee must not sexually harass- (a) another person employed by his or her employer; (b) his or her employer; (c) a person seeking employment with his or her employer. (3) For the purposes of this section- (a) a municipal councillor is to be taken to be an employer of employees of that council; (b) a member of the governing body (however called) of a body corporate or unincorporated association is to be taken to be an employer of employees of that body corporate or unincorporated association.
