Autopsies

126. Autopsies





(1) The Secretary may require a registered medical practitioner who has the
prescribed qualifications or experience in pathology to carry out an autopsy
on a body if-



   (a)  the Secretary reasonably believes that an infectious disease caused or
        contributed to the person's death; and

   (b)  the Coroner does not have jurisdiction over the body.

(2) For the purposes of carrying out an autopsy under this section, the
Secretary may order the person who has possession of the body to give
possession of that body to the registered medical practitioner.



(3) A person who has possession of a body must comply with an order of the
Secretary under this section.

Penalty applying to this subsection: 2 penalty units.
