Power to require information

406. Power to require information





(1) If in the opinion of the Secretary there is reasonable ground for
suspecting that any person is (for the purposes of sale manufacturing or
preparing for sale) in possession of any substance or appliance in
contravention of this Act the Secretary-





   (a)  may require such person to produce for the Secretary's inspection or
        to produce to any specially authorized officer any books of the nature
        of store records or dealing with the reception possession or delivery
        of any such substance or appliance; and







   (b)  may make or cause to be made copies of or extracts from any such
        books.

(2) Such copies of or extracts from any such books certified as such by any
specially authorized person shall be deemed to be true and correct copies or
extracts.

(3) Every person refusing to comply with any of the foregoing provisions of
this section shall be guilty of an offence against this Act.

(4) Every person who-

   (a)  does not maintain and aid in maintaining the secrecy of all matters
        which come to his knowledge in the performance of his duties under
        this section; or

   (b)  communicates any such matter to any person whomsoever except for the
        purpose of carrying into effect the provisions of this Act-

shall be guilty of an offence against this Act.
