407. Duties of officers seizing substances etc.





(1) Where any substance or animal or thing is seized by an authorized officer
pursuant to section 401, the authorized officer shall forthwith-

   (a)  give notice of the seizure in the prescribed form to the person
        apparently in charge thereof; or

   (b)  if there is no person apparently in charge thereof-give notice of the
        seizure to any person appearing to be the consignor or owner thereof
        by any name and address attached thereto or to any package containing
        the same if the address is a place in Victoria, and otherwise to the
        importer or consignee or his agent.

(2) Where any substance is seized by an authorized officer pursuant to section
405, the authorized officer shall forthwith deliver or forward a portion
thereof marked and sealed or fastened up in such a manner as its nature will
permit to any person appearing to be the consignor or manufacturer by any name
and address attached thereto or to any package containing the same if the
address is a place in Victoria, and otherwise to the importer or consignee or
his agent.

(3) No officer and no member of the police force seizing any substance or any
animal or thing and no inspector of livestock seizing any animal shall be
liable for any costs expenses or damages on account of the seizure if he acted
under a reasonable belief that the substance or animal or thing was
unwholesome or that the animal was diseased or that there was with respect to
any such substance or animal or thing any contravention of this Act.
