Powers of Authority in relation to fees (1) In the case of any fee for an application for, or renewal or issue of a licence or approval which the Authority is empowered to fix under this Act- (a) the Authority must determine the fee to be paid; and (b) the Authority may amend or vary such a fee; and (c) the Authority may determine a different fee for a different case or class of case and may allow for the reduction or refund, in whole or in part, of any such fee; and (d) before determining, amending or varying any fee as described in paragraph (a) or (b), the Authority must consult with the Minister; and (e) the Authority must cause any fee it has determined, amended or varied as described in paragraph (a) or (b) to be published in the Government Gazette. (2) In fixing fees under this Act the Authority is entitled to ensure that the amount of money collected in fees under this Act is sufficient to cover the cost to the Authority of its administration and of carrying out its powers, functions and duties under this Act.
