No action if gametes used without knowing consent withdrawn or lapsed

151. No action if gametes used without knowing consent withdrawn or lapsed

If-

   (a)  a person has carried out research under Part 3 or a treatment
        procedure for which consent was required; and

   (b)  before the research or treatment procedure was carried out, the
        consent was withdrawn or an objection was made under the Act-

no civil or criminal proceeding lies against that person because of the
withdrawal of the consent or objection if, at the time the treatment procedure
or research was carried out, that person did not know and could not reasonably
be expected to have known that the consent had been withdrawn or the objection
had been made.
