Interpretation4. Interpretation (1) In this Act, unless the contrary intention appears, a reference to- (a) a kind of procedure; or (b) a kind of fertilisation procedure; or (c) a kind of treatment procedure; or (d) a procedure, fertilisation procedure or treatment procedure of a particular kind- includes- (e) the nature or type of procedure or transfer; and (f) whether the procedure involves the use of a donor oocyte or donor sperm, or an embryo formed from sperm or an oocyte of a donor (or both); and (g) in relation to a consent, objection or withdrawal of consent or objection of a donor or his or her spouse, whether- (i) a gamete or embryo may be used in a treatment procedure to be carried out on a woman who is not the donor or the spouse of the donor; and (ii) a gamete or embryo may be used in such a procedure to be carried out on any woman, or only on a named woman. (2) In sections 62, 63, 66 and 82 and in any prescribed provision, unless the contrary intention appears, a reference to the husband of a woman who has undergone a treatment procedure, fertilisation procedure, donor treatment procedure, artificial insemination or donor insemination includes a reference to a man who was the woman's husband when the procedure was carried out.
