A Bill for
An Act to amend the Aquatic Resources Management Act 2015 and
the Fishing Industry Promotion Training and Management Levy
Act 1994.
The Parliament of Western Australia enacts as follows:

1 Part 1 -- Preliminary
2 1. Short title
3 This is the Aquatic Resources Legislation Amendment Act 2015.
4 2. Commencement
5 This Act comes into operation as follows --
6 (a) Part 1 -- on the day on which this Act receives the
7 Royal Assent;
8 (b) Part 2 -- on the day on which the Aquatic Resources
9 Management Act 2015 section 263 comes into
10 operation;
11 (c) Part 3 -- on the day on which the Aquatic Resources
12 Management Act 2015 section 267 comes into operation.

4 This Part amends the Aquatic Resources Management Act 2015.
5 4. Section 263 amended
6 After section 263(5) insert:

8 (6) To the extent that the regulations prescribe under
9 subsection (2)(j) a fee that includes an amount referred
10 to in subsection (5) that is a tax, the regulations may
11 impose the tax.

5 Management Levy Act 1994.
6 6. Section 5 replaced
7 Delete section 5 and insert:

9 5. Levy imposed
10 If an amount by way of levy is prescribed in respect of
11 a licence or resource share, that levy is imposed in
12 respect of the licence or resource share.
