A Bill for
An Act to amend the Biological Control Act 1986.
The Parliament of Western Australia enacts as follows:

1 1. Short title
2 This is the Biological Control Amendment Act 2016.
3 2. Commencement
4 This Act comes into operation as follows --
5 (a) sections 1 and 2 -- on the day on which this Act
6 receives the Royal Assent;
7 (b) the rest of the Act -- on a day fixed by proclamation.
8 3. Act amended
9 This Act amends the Biological Control Act 1986.
10 4. Section 3 amended
11 (1) In section 3(1) delete the definition of prescribed live
12 organisms.
13 (2) In section 3(1) insert in alphabetical order:

15 prescribed organisms --
16 (a) means organisms that are --
17 (i) live organisms; or
18 (ii) viruses or sub-viral agents;
19 but
20 (b) does not include live vaccines or resistant
21 cultivars;

23 (3) In section 3(1) in the definition of kind after "organisms,"
24 insert:

26 viruses or sub-viral agents,

1 (4) In section 3(1) in the definition of organism --
2 (a) in paragraph (b) delete "paragraph (a);" and insert:

4 paragraph (a); or

6 (b) after paragraph (b) insert:

11 In section 4 delete "live" and insert:

22 (1) In this section --
23 commencement day means the day on which the
24 Biological Control Amendment Act 2016 section 6
25 comes into operation;
26 existing declaration means a declaration made under
27 section 5 and in effect immediately before the
28 commencement day.

1 (2) An existing declaration continues in effect and may be
2 dealt with on and after the commencement day despite
3 the amendments made by the Biological Control
4 Amendment Act 2016.
