Alison Xamon MLC) Electoral Amendment (Access to Ministers) Bill 2012 A Bill for An Act to amend the Electoral Act 1907. The Parliament of Western Australia enacts as follows: page 1 Electoral Amendment (Access to Ministers) Bill 2012 s. 1 1 1. Short title 2 This is the Electoral Amendment (Access to Ministers) 3 Act 2012. 4 2. Commencement 5 This Act comes into operation as follows -- 6 (a) sections 1 and 2 -- on the day on which this Act 7 receives the Royal Assent; 8 (b) the rest of the Act -- on the day after that day. 9 3. Act amended 10 This Act amends the Electoral Act 1907. 11 4. Section 176 inserted 12 After section 175ZG insert: 13 14 176. Ministerial access not to be used to raise 15 political funds 16 (1) In this section -- 17 Minister means a Minister in the Government; 18 political fundraising event means a function, gathering 19 or other event a purpose of which is to raise funds 20 for -- 21 (a) a political party or an associated entity; or 22 (b) a candidate or group in an election; or 23 (c) a person to whom section 175Q applies. 24 (2) A person who promotes a political fundraising event in 25 a way that indicates -- 26 (a) that a Minister will be present at the event; and page 2 Electoral Amendment (Access to Ministers) Bill 2012 s. 4 1 (b) that other persons attending the event will have 2 access to the Minister at the event or in 3 association with the event, 4 commits an offence and is liable to a fine not 5 exceeding $10 000. 6 (3) Subsection (2) does not apply if the promotion of the 7 event indicates that the Minister will be present at the 8 event in his or her capacity as a member of Parliament 9 and not in his or her capacity as a Minister. 10 (4) A person who organises, holds or conducts a political 11 fundraising event that is promoted in a way that 12 contravenes subsection (2) commits an offence and is 13 liable to a fine not exceeding $10 000. 14
