The Parliament of Western Australia enacts as follows: page 1 Litter Amendment (Balloons) Bill 2018 s. 1 1 1. Short title 2 This is the Litter Amendment (Balloons) Act 2018. 3 2. Commencement 4 This Act comes into operation as follows -- 5 (a) sections 1 and 2 -- on the day on which this Act 6 receives the Royal Assent; 7 (b) the rest of the Act -- on the 60th day after that day. 8 3. Act amended 9 This Act amends the Litter Act 1979. 10 4. Section 24D inserted 11 After section 24C insert: 12 24D. Inflating a party balloon outdoors, or having or 13 releasing an inflated party balloon outdoors, offence 14 (1) In this section -- 15 inflated means inflation with a liquid or gas; 16 party balloon includes but is not limited to a balloon 17 used for purposes of play or entertainment, celebration, 18 decoration, commiseration or remembrance. 19 (2) Any person who -- 20 (a) inflates a party balloon outdoors or has an 21 inflated party balloon outdoors; or 22 (b) releases an inflated party balloon outdoors or 23 causes an inflated party balloon to be released 24 outdoors, page 2 Litter Amendment (Balloons) Bill 2018 s. 4 1 Penalty: 2 (a) for an individual, a fine of $5 000; 3 (b) for a body corporate, a fine of $10 000. 4
