The Criminal Code; and
the Road Traffic Act 1974,
and for related purposes.
The Parliament of Western Australia enacts as follows:

1 Part 1 -- Preliminary
2 1. Short title
3 This is the Manslaughter Legislation Amendment Act 2011.
4 2. Commencement
5 This Act comes into operation as follows --
6 (a) sections 1 and 2 -- on the day on which this Act
7 receives the Royal Assent;
8 (b) the rest of the Act -- on a day fixed by proclamation,
9 and different days may be fixed for different provisions.

3 This Part amends the Road Traffic Act 1974.
4 6. Section 59 amended
5 (1) In section 59(1) in the Summary conviction penalty delete
6 "penalty:" and insert:

8 penalty in a case in which the incident does not
9 occasion the death of another person:

11 (2) After section 59(1) insert:

13 (2A) For an offence against this section that was committed
14 before the day on which the Manslaughter Legislation
15 Amendment Act 2011 section 6(1) came into operation
16 amending subsection (1), subsection (1) applies as if
17 that amendment had not been made.

19 7. Section 67 amended
