Termination of adoption 3 Defined Terms 163--1 page i Western Australia LEGISLATIVE ASSEMBLY Mutual Recognition (Western Australia) Bill 2010 A Bill for An Act to continue the adoption of the Mutual Recognition Act 1992 of the Parliament of the Commonwealth (and any amendments made to it before the enactment of this Act) which provides for the recognition within each State and Territory of the Commonwealth of regulatory standards adopted elsewhere in Australia regarding goods and occupations, and for related purposes. The Parliament of Western Australia enacts as follows: page 1 Mutual Recognition (Western Australia) Bill 2010 s. 1 1 1. Short title 2 This is the Mutual Recognition (Western Australia) Act 2010. 3 2. Commencement 4 This Act comes into operation as follows -- 5 (a) sections 1 and 2 -- on the day on which this Act 6 receives the Royal Assent; 7 (b) the rest of the Act -- on 1 March 2011. 8 3. Terms used 9 In this Act -- 10 adopt has the same meaning as in the Constitution of the 11 Commonwealth section 51(xxxvii); 12 Commonwealth Act means the Mutual Recognition Act 1992 13 (Commonwealth). 14 4. Adoption of Commonwealth Act 15 (1) The State of Western Australia adopts the Commonwealth Act 16 as originally enacted and any amendments made to it before this 17 Act receives the Royal Assent. 18 (2) The adoption of the Commonwealth Act under this Act does not 19 operate so as to give effect to any adopted provision before that 20 provision commences as a law of the Commonwealth. 21 (3) To avoid doubt, it is the intention of the Parliament of the State 22 that a Schedule to the Commonwealth Act as adopted under this 23 Act may be amended from time to time by regulations made 24 under the Commonwealth Act. 25 (4) The Minister is to cause a copy of any regulations referred to in 26 subsection (3) to be laid before each House of Parliament within 27 14 sitting days of that House after the registration of the 28 regulations in the Federal Register of Legislative Instruments 29 maintained under the Legislative Instruments Act 2003 30 (Commonwealth). page 2 Mutual Recognition (Western Australia) Bill 2010 s. 5 1 5. Regulations for temporary exemption for goods 2 Without limiting any other power to make regulations under any 3 other Act, the Governor may make regulations for the purposes 4 mentioned in the Commonwealth Act section 15 as adopted 5 under this Act. 6 6. Termination of adoption 7 (1) The adoption of the Commonwealth Act under this Act ends 8 on -- 9 (a) 28 February 2021; or 10 (b) if an earlier date is fixed under subsection (2), that 11 earlier day. 12 (2) The Governor may, by proclamation, fix a day that is earlier 13 than 28 February 2021 as the day on which the adoption of the 14 Commonwealth Act under this Act ends. 15 (3) This Act expires when the adoption of the Commonwealth Act 16 ends under subsection (1). 17 page 3 Mutual Recognition (Western Australia) Bill 2010 Defined Terms Defined Terms [This is a list of terms defined and the provisions where they are defined.
