            POLICE ACT AMENDMENT
              (GRAFFITI) BILL 1997
                               A BILL FOR


                   AN ACT to amend the Police Act 1892.

     The Parliament of Western Australia enacts as follows:


     Short title
     1. This Act may be referred to as the Police Act Amendment
     (Graffiti) Act 1997.


 5   Commencement
     2. This Act comes into operation on the day on which it
     receives the Royal Assent.


     Principal Act
     3. In this Act the Police Act 1892* is referred to as the
10   principal Act.

        New section 65A

        4. The principal Act is amended by inserting after section 65
        the following --

             ''
 5                Carrying graffiti instruments

                  65A. (1) Any person who, between sunset
                  and sunrise, without lawful excuse --

                       (a)   in a public place; or

                       (b)   a place on which the
10                           person is trespassing or
                             has entered without
                             invitation,

                  carries or has on or about his person or in
                  his possession any instrument or thing --

15                     (c)   capable of being used to
                             cause damage to property
                             where such damage could
                             consist of graffiti; or

                       (d)   of a class       prescribed   by
20                           regulation,

                  commits an offence.

                  Penalty: A fine not exceeding $500.

                     (2) Every such instrument or thing
                  shall, on conviction of the offender, become
25                forfeited to the Crown.
