Hames, MLA) Road Traffic (Smoking in Motor Vehicles) Amendment Bill 2006 A Bill for An Act to amend the Road Traffic Act 1994 to prohibit smoking in motor vehicles in which a child is present. The Parliament of Western Australia enacts as follows: page 1 Road Traffic (Smoking in Motor Vehicles) Amendment Bill 2006 Part 1 Preliminary s. 1 Part 1 -- Preliminary 1. Short title This Act may be cited as the Road Traffic (Smoking in Motor Vehicles) Amendment Act 2006. 5 2. Commencement This Act comes into operation on a day fixed by proclamation. page 2 Road Traffic (Smoking in Motor Vehicles) Amendment Bill 2006 Amendment of Road Traffic Act 1994 Part 2 s. 3 Part 2 -- Amendment of Road Traffic Act 1994 3. The Act amended The amendments in this Part are to the Road Traffic Act 1994. 4. Section 62B inserted 5 After section 62A the following section is inserted -- " 62B. Smoking in motor vehicles (1) A person who smokes inside a motor vehicle, whether in motion or at rest, when any other person inside the 10 motor vehicle has not yet attained the minimum age of 17 years, commits an offence. Penalty: 2 PU. (2) In this section -- "smoke" has the same meaning as in section 289E of 15 the Health Act 1911. ".
