The Parliament of Western Australia enacts as follows: page 1 Railway (Tilley to Karara) Bill 2010 Part 1 Preliminary s. 1 1 Part 1 -- Preliminary 2 1. Short title 3 This is the Railway (Tilley to Karara) Act 2010. 4 2. Commencement 5 This Act comes into operation on the day on which it receives 6 the Royal Assent. page 2 Railway (Tilley to Karara) Bill 2010 Authority to construct railway Part 2 s. 3 1 Part 2 -- Authority to construct railway 2 3. Authority to construct Tilley to Karara railway 3 A railway, with all necessary, proper and usual works and 4 facilities in connection with the railway, may be constructed and 5 maintained along the line described in Schedule 1. page 3 Railway (Tilley to Karara) Bill 2010 Part 3 Application of various written laws if construction of railway undertaken by contractor s. 4 1 Part 3 -- Application of various written laws if 2 construction of railway undertaken by contractor 3 4. Terms used 4 In this Part -- 5 proposal has the meaning given in the Environmental 6 Protection Act 1986 section 3(1); 7 Public Transport Authority means the Public Transport 8 Authority of Western Australia established under the Public 9 Transport Authority Act 2003 section 5; 10 specified means specified or described in the regulations. 11 5. Application of Part 12 This Part applies if the Public Transport Authority enters into a 13 contract or arrangement with another person (the contractor) for 14 the construction of all, or part, of the railway (the construction 15 of the railway). 16 6. Aboriginal Heritage Act 1972 17 For the purposes of the construction of the railway, the 18 Aboriginal Heritage Act 1972 applies in relation to any land 19 required to be used for the construction of the railway as if the 20 contractor were the owner of that land. 21 7. Environmental Protection Act 1986 22 For the purposes of the construction of the railway, the 23 Environmental Protection Act 1986 applies as if, despite 24 anything else in that Act, the contractor had been nominated 25 under section 38(6) of that Act as the person responsible for any 26 proposal in respect of the construction of the railway. 27 8. The Tilley to Karara railway commences about 336.5 kilometres 4 along the Avon Yard to Mullewa Railway line at point 1 in the 5 sequence specified in the Table then continues, generally in an 6 easterly or south-easterly direction, along a straight line between each 7 of the points in the sequence, and terminates at point 10, about 8 74 kilometres from point 1. 9 Table Point no.
