The Parliament of Western Australia enacts as follows: page 1 Road Traffic Legislation Amendment (Disqualification for Life) Bill 2016 Part 1 Preliminary s. 1 1 Part 1 -- Preliminary 2 1. Short title 3 This is the Road Traffic Legislation Amendment 4 (Disqualification for Life) Act 2016. 5 2. Commencement 6 This Act comes into operation as follows -- 7 (a) Part 1 -- on the day on which this Act receives the 8 Royal Assent; 9 (b) the rest of the Act -- on the day after that day. page 2 Road Traffic Legislation Amendment (Disqualification for Life) Bill 2016 Amendments to the Road Traffic Act 1974 Part 2 s. 3 1 Part 2 -- Amendments to the Road Traffic Act 1974 2 3. Act amended 3 This Part amends the Road Traffic Act 1974. 4 4. Section 59 amended 5 (1) In section 59(3): 6 (a) in paragraph (b)(ii) delete "person," and insert: 7 8 person. 9 10 (b) delete "and, in any event, the court convicting that 11 person shall order that he be disqualified from holding 12 or obtaining a driver's licence for a period of not less 13 than 2 years.". 14 (2) After section 59(4B) insert: 15 16 (4C) A court convicting a person on indictment of an 17 offence against this section must order -- 18 (a) that the person be permanently disqualified 19 from holding or obtaining a driver's licence, if 20 the incident occasions the death of another 21 person and either -- 22 (i) the offence is against subsection (1)(a), 23 (ba) or (bb); or 24 (ii) the offence is against subsection (1)(b) 25 and is committed in circumstances of 26 aggravation; 27 or 28 (b) that the person be disqualified from holding or 29 obtaining a driver's licence for a period of not 30 less than 2 years, in any other case. 31 page 3 Road Traffic Legislation Amendment (Disqualification for Life) Bill 2016 Part 3 Amendments to the Road Traffic (Authorisation to Drive) Act 2008 s. 5 1 Part 3 -- Amendments to the Road Traffic 2 (Authorisation to Drive) Act 2008 3 5. Act amended 4 This Part amends the Road Traffic (Authorisation to Drive) 5 Act 2008. 6 6. Section 27 amended 7 In section 27(3): 8 (a) after paragraph (a) insert: 9 10 (aa) by an order made under the Road Traffic 11 Act 1974 section 59(4C)(a); or 12 13 (b) delete "paragraph (a), (ba)" and insert: 14 15 paragraph (a), (aa), (ba) 16 17
