A Bill for
An Act to amend the Taxi Act 1994.
The Parliament of Western Australia enacts as follows:

1 1. Short title
2 This is the Taxi Amendment Act 2016.
3 2. Commencement
4 This Act comes into operation as follows --
5 (a) sections 1 and 2 -- on the day on which this Act
6 receives the Royal Assent;
7 (b) the rest of the Act -- on a day fixed by proclamation,
8 and different days may be fixed for different provisions.

10 This Act amends the Taxi Act 1994.

18 Part 3A -- Adjustment assistance grants
19 30J. Terms used
20 In this Part --
21 eligible owner, of taxi plates, means a person who --
22 (a) is the owner, or has an interest in the
23 ownership, of the taxi plates; and

1 (b) became the owner, or acquired the interest in
2 the ownership, of the taxi plates --
3 (i) before 18 December 2015; or
4 (ii) on or after 18 December 2015, but only
5 if the application under section 24 for
6 approval of the transfer of the
7 ownership, or the interest in the
8 ownership, of the taxi plates to the
9 person was made before that day;
10 restricted taxi plates means taxi plates used, or to be
11 used, on a taxi operated subject to conditions restricting
12 the operation of the taxi to specified times or areas.
13 30K. Application for adjustment assistance grant
14 (1) An eligible owner of taxi plates may apply for an
15 adjustment assistance grant in respect of the taxi plates.
16 (2) The application must be made to the Director General
17 in the approved form on or before the prescribed day.
18 (3) If the application is for an adjustment assistance grant
19 in respect of taxi plates owned by 2 or more eligible
20 owners in partnership, the application must --
21 (a) be made jointly by the eligible owners; and
22 (b) specify a particular person who is to receive the
23 grant on behalf of the eligible owners.
24 (4) An applicant must provide any additional information
25 that the Director General may require for the proper
26 consideration of the application.
27 (5) The Director General may require any information
28 provided with an application to be verified by a
29 statutory declaration.

1 30L. Requirement to grant application for adjustment
2 assistance grant
3 The Director General must, by notice in writing, grant
4 an application for an adjustment assistance grant in
5 respect of taxi plates if satisfied that --
6 (a) the applicant, or in the case of a joint
7 application each applicant, is the eligible owner
8 of the taxi plates; and
9 (b) no other application for an adjustment
10 assistance grant in respect of the taxi plates has
11 been granted.
12 30M. Amount and payment of adjustment assistance
13 grant
14 (1) The amount of an adjustment assistance grant is --
15 (a) in respect of taxi plates other than restricted
16 taxi plates -- $20 000; or
17 (b) in respect of restricted taxi plates -- $6 000.
18 (2) An adjustment assistance grant in respect of taxi plates
19 is to be paid to --
20 (a) the applicant; or
21 (b) if the application specifies a person who is to
22 receive the grant on behalf of the eligible
23 owners of the taxi plates -- that person.
24 (3) No more than one adjustment assistance grant may be
25 paid in respect of the same taxi plates.
26 (4) The payment of an adjustment assistance grant is to be
27 charged to the Taxi Industry Development Account.
