The Parliament of Western Australia enacts as follows: page 1 Waste Avoidance and Resource Recovery Amendment (Validation) Bill 2014 s. 1 1 1. Short title 2 This is the Waste Avoidance and Resource Recovery 3 Amendment (Validation) Act 2014. 4 2. Commencement 5 This Act comes into operation on the day on which it receives 6 the Royal Assent. 7 3. Act amended 8 This Act amends the Waste Avoidance and Resource Recovery 9 Act 2007. 10 4. Section 102 inserted 11 At the end of Part 9 insert: 12 13 102. Waste Avoidance and Resource Recovery Levy 14 Regulations 2008 and amendments validated 15 (1) The following regulations are to be taken to have been 16 validly made and to have, and to have always had, full 17 force and effect -- 18 (a) the Waste Avoidance and Resource Recovery 19 Levy Regulations 2008; 20 (b) the Waste Avoidance and Resource Recovery 21 Levy Amendment Regulations 2009; 22 (c) the Waste Avoidance and Resource Recovery 23 Levy Amendment Regulations 2011. 24 (2) The rights, obligations and liabilities of all persons are 25 to be taken to be, and to have always been, the same as 26 if the regulations listed in subsection (1) had been 27 validly made. page 2 Waste Avoidance and Resource Recovery Amendment (Validation) Bill 2014 s. 4 1 (3) Anything done, or purportedly done, before the Waste 2 Avoidance and Resource Recovery Amendment 3 (Validation) Act 2014 section 4 comes into operation is 4 as valid and effective, and is to be taken to have always 5 been as valid and effective, as it would have been if the 6 regulations listed in subsection (1) had been valid at the 7 time the thing was done. 8 (4) In subsection (3), a reference to the doing of anything 9 includes a reference to an omission to do anything. 10 11
