Margaret Quirk, MLA) Weapons (Supply to Minors and Enhanced Police Powers) Amendment Bill 2008 A Bill for An Act to amend the Weapons Act 1999 to prohibit the supply of controlled weapons to minors and to provide the Police Force with greater search powers in certain circumstances. The Parliament of Western Australia enacts as follows: page 1 Weapons (Supply to Minors and Enhanced Police Powers) Amendment Bill 2008 s. 1 1. Short title This is the Weapons (Supply to Minors and Enhanced Police Powers) Amendment Act 2008. 2. Commencement 5 This Act comes into operation on a day fixed by proclamation. 3. Act amended This Act amends the Weapons Act 1999. 4. Section 7A inserted After section 7 insert: 10 7A. Supply of controlled weapons to minors (1) Subject to subsection (2), a person must not supply a controlled weapon to a person who is under 18 years of age. 15 Penalty: $4,000 or imprisonment for 12 months. (2) A person does not commit an offence under subsection (1) if that person has an honest and reasonable belief that the person under the age of 18 years intended to use the controlled weapon -- 20 (a) in a lawful sporting or recreational activity; or (b) for such other purpose as may be prescribed by regulations. page 2 Weapons (Supply to Minors and Enhanced Police Powers) Amendment Bill 2008 s. 5 5. Section 13 amended After subsection (1) insert: (1a) A member of the Police Force may without a warrant 5 stop, detain and search anyone who is present within a prescribed area at a prescribed time to determine whether that person is -- (a) committing an offence; (b) carrying a weapon relating to an offence; or 10 (c) carrying something else that will afford evidence as to the commission of an offence. 6. Section 13 amended After subsection (3) insert: 15 (4) Regulations for the purpose of subsection (1a) must prescribe -- (a) the geographical area to which the regulation applies; and 20 (b) the times at which the regulation applies. page 3
