(1) After a statutory
manager has been appointed to administer the affairs of an incorporated
association, a person cannot begin or continue a proceeding in a court against
the association until the appointment of the statutory manager is revoked
except —
(a) with
the leave of the Supreme Court; and
(b) if
that Court grants leave, in accordance with the terms and conditions that it
imposes.
(2) A person intending
to apply for leave of the Supreme Court under subsection (1) must give the
Commissioner not less than 10 days’ notice of that intention.
Penalty: a fine of $5 000.
(3) On the hearing of
an application under subsection (1), the Commissioner may be represented and
may oppose the granting of the application.
