(1) A person must not
in a document required by or for the purposes of this Act or lodged with or
submitted to the Commissioner or in a document submitted to a meeting of
members of an incorporated association —
(a) make
or authorise the making of a statement that to the person’s knowledge is
false or misleading in any material particular; or
(b) omit
or authorise the omission of any matter or thing without which the document is
to the person’s knowledge misleading in any material respect.
Penalty: a fine of $5 000.
(2) This section does
not limit or affect the operation of section 172 insofar as it applies to the
Fair Trading Act 2010 section 88.
