(1) If a dispute
cannot be resolved under the procedure provided for as required by Schedule 1
Division 1 item 18 —
(a) the
incorporated association concerned; or
(b) a
member of the association involved in the dispute,
may make an
application to the State Administrative Tribunal to have the dispute
determined by that Tribunal.
(2) Nothing in
subsection (1) prevents the State Administrative Tribunal from exercising its
powers to refer the dispute, or any aspect of it, for mediation.
(3) In a proceeding
under subsection (1), the State Administrative Tribunal may make orders giving
such relief as the Tribunal considers appropriate, including one or more of
the following orders —
(a) an
order giving directions for the observance of the rules of the incorporated
association by any person who has an obligation to observe those rules;
(b) an
order declaring and enforcing the rights and obligations of members of the
incorporated association between themselves;
(c) an
order declaring and enforcing the rights and obligations between the
incorporated association and any member or members of the association.
