(1) At a general
meeting of an incorporated association at which a resolution proposed as a
special resolution is submitted, a declaration by the person presiding that
the resolution has been passed as a special resolution is evidence of the
fact.
(2) Subsection (1)
does not apply if, during the meeting at which the resolution is submitted, a
poll is demanded —
(a) in
accordance with the rules of the incorporated association; or
(b) if
the rules do not make provision as to the manner in which a poll may be
demanded, by at least 3 members of the association present in person or, where
proxies are allowed, by proxy.
(3) If a poll is taken
under subsection (2), a declaration by the person presiding as to the result
of a poll is evidence of the matter so declared.
