ENVIRONMENTAL PROTECTION ACT 1986 - SECT 50A

50A .         Causing serious environmental harm

        (1)         A person who, intentionally or with criminal negligence —

            (a)         causes serious environmental harm; or

            (b)         allows serious environmental harm to be caused,

                commits an offence.

        (2)         A person who —

            (a)         causes serious environmental harm; or

            (b)         allows serious environmental harm to be caused,

                commits an offence.

        (3)         A person charged with committing an offence against subsection (1) may be convicted of an offence against subsection (2) which is established by the evidence.
