(1) Nothing in
section 25 prevents the Principal Registrar or any registrar from being
appointed and holding office as a magistrate under the
Magistrates Court Act 2004 .
(2) During any period
when a person who is the Principal Registrar or a registrar is a magistrate,
the person is not a member of the Public Service and references in this Act to
the Public Service and to Part 3 of the Public Sector Management Act 1994 do
not apply to that person.
(3) If the Principal
Registrar and any one or more registrars hold office as magistrates, the
Principal Registrar is the senior of them.
(4) This Act does not
prevent a family law magistrate from constituting the Magistrates Court at a
place in or outside the metropolitan region.
