(1) Before commencing
to perform the functions of the office of Commissioner or Acting Commissioner
a person has to take an oath or make an affirmation that he or she will
faithfully and impartially perform the functions of the office, and that he or
she will not, except in accordance with this Act, divulge any information
received under this Act.
(2) The oath or
affirmation is to be administered by the Speaker of the Legislative Assembly.
(3) If the office of
Speaker is vacant or the Speaker is absent or otherwise unable to administer
the oath or affirmation, the President of the Legislative Council is to
administer the oath or affirmation.
(4) If subsections (2)
and (3) do not enable the oath or affirmation to be administered, it is to be
administered by a person appointed by the Governor for the purpose.
