(1) Access to
documents is to be given under Parts 2 and 4 despite any prohibitions or
restrictions imposed by other enactments (whether enacted before or after the
commencement of this Act) on the communication or divulging of information,
and a person does not commit an offence against any such enactment merely by
complying with this Act.
(2) Subsection (1)
applies in respect of any enactment (whether enacted before or after the
commencement of this Act) unless the enactment is expressly stated to have
effect despite this Act.
(3) The application of
subsection (1) is subject to clause 14 of Schedule 1.
(4) The application of
subsection (1) is subject to the Royal Commission (Custody of Records) Act
1992 .
(5) A person’s
right to be given access to a document that is a State archive is subject to
Part 6 of the State Records Act 2000 .
